Terms & Conditions

This Terms & Conditions agreement (“Agreement”) is a legally binding contract between you (“User,” “you”) and Marelgra LLC, doing business as **Kasimu** (“Kasimu,” “we,” “us,” or “our”), governing your access to and use of the Kasimu Global and Kasimu Freedom music streaming services available at https://www.kasimu.us (the “Services”).

1. Eligibility
By creating a Kasimu account, you represent and warrant that you are at least 18 years old, that you have the legal authority to enter into this Agreement, and that all information you provide is accurate, complete, and up to date.

2. Acceptance and Changes
By accessing or using the Services, you agree to be bound by this Agreement. Kasimu may update these Terms at any time. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

3. License and Permitted Use
Kasimu grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful commercial purposes. You may not copy, record, distribute, sublicense, resell, or otherwise exploit the content or Services except as expressly permitted herein.

4. Subscription Fees and Billing
Certain Services require payment of subscription fees. Fees are billed in advance and are non-refundable. Subscriptions automatically renew unless canceled before the end of the current billing period. You authorize Kasimu or its payment processors to charge your selected payment method.

5. Public Performance Rights
Kasimu Global does not include public performance rights.
Kasimu Freedom includes public performance rights for the musical works provided within the Kasimu Freedom catalog, which consists exclusively of music licensed directly from rights holders and not affiliated with collective management organizations. Other rights, if applicable under local law, remain the responsibility of the User.

6. Prohibited Conduct
You agree not to:
(a) copy, record, extract, or redistribute music or content;
(b) share login credentials or access accounts not assigned to you;
(c) bypass or interfere with security or usage controls;
(d) use the Services in violation of applicable laws or regulations;
(e) use the Services outside authorized territories or locations.

7. Account Termination
You may cancel your subscription at any time through your account or by contacting Kasimu support. Kasimu may suspend or terminate access at its discretion in the event of misuse, violation of this Agreement, or unlawful activity. No refunds will be issued for unused subscription periods.

8. Disclaimer of Warranties
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASIMU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASIMU SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE USE OF THE SERVICES.

10. Indemnification
You agree to indemnify and hold harmless Kasimu, its affiliates, officers, employees, and licensors from any claims, damages, losses, or expenses arising from your use of the Services or violation of this Agreement.

11. Service Availability
Kasimu does not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of the Services at any time.

12. Assignment
Kasimu may assign this Agreement without restriction. You may not assign this Agreement without prior written consent.

13. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the United States and the State designated by Kasimu, without regard to conflict of law principles. Exclusive jurisdiction shall lie in the appropriate courts designated by Kasimu.
